After years of debate, the BIOSECURE Act is moving toward becoming law as part of the National Defense Authorization Act. While narrower than earlier proposals, it keeps the core idea intact: blocking U.S. federal funding from flowing to risky foreign-adversary biotech firms—while softening and restructuring how the policy works.

Rather than naming specific Chinese companies, the revised language relies on the Defense Department’s 1260H list and a new designation process, with implementation tied to FAR updates and a more staged compliance timeline. It also adds clearer waivers, public-health emergency carve-outs, safe harbors for legacy products, and protections to avoid unintended disruptions to Medicaid and VA drug pricing.
